Guns in the Wrong Hands

Felons and juveniles illegally possess guns in Milwaukee

The vast majority of gun owners purchase and use firearms legally. But a new study of guns seized by the Milwaukee Police Department (MPD) shows that felons and juveniles—who are not allowed to legally possess guns— are getting their hands on them.

According to UW-Milwaukee professor Steven Brandl’s new report, more than 40% of the guns seized by the MPD in 2005 were possessed by these two groups. And since felons and juveniles aren’t able to legally purchase guns from a licensed dealer, they are doing so illegally on the secondary gun market—at a gun show, from an individual or from a “straw buyer,” who purchases the gun legally and then passes it on to someone else.

“Chances are that the person did not go into the store and buy the gun,” said Brandl, who also chairs the city of Milwaukee Homicide Review Commission. “There may have been a series of transactions before it wound up in that person’s hands.”

Who Bought and Possessed Milwaukee’s Crime Guns
Brandl reviewed the MPD’s 2005 firearm reports and the Bureau of Alcohol, Tobacco and Firearm’s (ATF) trace data, and compared the names of the original, legal purchaser (say, at a gun shop) and the name and identifying characteristics of the individual who possessed the gun when the MPD seized it. Brandl looked at “arrest guns,” guns that were seized as a result of someone illegally carrying, possessing or using the firearm; “crime guns,” guns that were seized as a result of being used in a criminal act, but no arrest was made; “suicide guns,” seized as a result of a suicide or a suicide attempt; “safekeeping guns,” which were seized by the MPD during a domestic dispute, for example; and other guns, such as those recovered during a gun buy-back program.

Brandl found:

- 30% of “arrest guns” were from previously convicted felons

- 11% of guns confiscated during arrests were from juveniles

- One-quarter of the guns seized were originally sold at Badger Outdoors, a gun dealer in West Milwaukee

- About 90% of those who possessed the gun at the time of the arrest were not the original purchaser of the gun. But buyers and possessors often live in the same neighborhoods, and are most often the same age (18-24 years), male and African American.

Brandl also looked at the “time-to-crime,” or the moment when the gun is legally purchased to when it is seized by the MPD. The faster the time-to-crime, the more likely it was purchased by a straw buyer for another individual.

Brandl found the time-to-crime to be extremely fast in Milwaukee. Almost 20% of guns seized had a time-to-crime of less than one year; another 35% had time-to-crime of less than three years. About 38% of the guns originally sold at Badger Outdoors had a time-to-crime of less than one year. The average time-to-crime for a Badger Outdoors firearm is 1,055 days, the shortest time-to-crime of any dealer represented.

Guns legally purchased by African-American women and young adults also had quick times-to-crime.

What Can Be Done?
Brandl said that understanding the illegal secondary gun market is important to learning about crime in the city, and he hopes that future policies will be based on solid research that makes the secondary market more visible.

Brandl said the good news and the bad news is that Milwaukee’s secondary gun market is local—the seller, purchaser and possessor are likely to be found in or near the city. In other states, Brandl said, the guns often were originally purchased all over the country, which means that competing state laws govern the sales.

“We have the capability to deal with the problem,” Brandl said.

Currently, private sellers, unlike licensed dealers, do not have to run background check on those who purchase guns from them, although selling to a felon or a juvenile is illegal.

Attempts to require background checks on all secondary gun sales have been stymied in the state Legislature. Jeri Bonavia, executive director of the Wisconsin Anti-Violence Effort, said that closing this loophole would provide one more barrier to allowing a felon or juvenile to access guns.

“It is illegal to sell a gun to a felon, but without a background check, you can’t prove that the seller knows that the purchaser is a felon,” Bonavia said. “And we have to hold people accountable.” Bonavia emphasized the importance of keeping guns out of the hands of juveniles and felons.

Wow you mean the people that are committing armed crimes in Milwaukee are getting the guns illegally? Huh, I never would have suspected that. I thought law abiding citizens that were legally buying guns were committing all the crimes around here. Good thing we don't have concealed carry laws.

 

What's funny, darksacks, isn't your attempt at sarcasm, but the fact that too many (if not all) conservatives believe that a concealed carry law will reduce gun crime in the city. How does that make any sense at all? "I know how we can solve the gun problem in our city. Add more guns." That doesn't add up to me. This isn't the Wild West.

 

Meepos, most studies show that concealed carry laws reduce not only gun crime, but other violent crimes as well such as rape. This is partly due to the desire of potential criminals to avoid confrontation. I disagree with you entirely in that this actually is the Wild West, only the bad guys have all the guns. Just look at the recent armed robberies near UWM. Those criminals were targeting people that they knew to be unarmed and easy to push over. I think if there was concealed carry things like that wouldn't be on the rise. Also, I think my sarcasm was appropriate and effective given the obviousness of this report.

Brandl's report was probably thoroughly researced and reflects a lot of statistical comparisons. The misleading part of the report is that it uses percentages. Percentages of what? Percentages can be used to paint any picture one wishes to present. They can be used to defend an agenda or to contest one. Example: 40% of what, 4 out of 10, 40 out of 100? What are the numbers. Of each of the types of crimes listed how many involved firearms and then of those that involved firearms how many involved illegaly purchase guns. Those are the numbers we need. To maqke a rational conclusiuon we need things put into perpective.

Let's get this straight once and for all. There is NO Gun Show loophole... NONE! Every sale has to go thru the same instant check that it would if the firearmwere purchased in the Gun Shop, and the same ATF forms have to be filled out, along with proper ID shown. It's not surprising that most of the guns confisgated from criminals in the commission of a crime were illegally, it only proves the point that most legal gun owners are more likely to obey the law and not have run-in's with the Police. Among people who posses Carry Licenses, this particular cohort is among the most law abiding of all citizens, because they realize all the hoops and hurdles they were required to jump through to obtain the Carry permit were nowall for naught, once you are convicted of a crime, you lose your carry license as well as your right to own firearms period. The sport shooter, or the person who relies upon his firearm to conduct business such as those who routinely carry large amounts of cash or gems are probably now out of business. When you mention percentages, list how large the sample roup was, and where the sample group was collected from. If I only interviewed child molestors, I could say, 95 % of those interviewed stated once released from prison, they would probably commit the same crime, but what does this really tell us? Nothing we didn't already know.

It is the systemic evolution of both police and military, with all their resources and organization that facilitate the largest arms dealers in the world by maintaining the staus quo; the social order of capitalism with all it discontents. To truly answer the question of guns in the wrong hands, one only needs look to these gangsters in uniforms. It's actually capitalism's indictments that has proven to be the biggest weapon wielded against the masses both foreign and domestic, administrated by the most ruthless, juvenile and felonous of people. It is only the hidden forces of these markets, that are the true enemy of all humanity. The obsession of death and destruction can be abandoned and a new world can be realized by the will of all people united against this failed system called capitalism. Let us NOT focus our attention on the petty criminal's and instead focus on removing the larger ones and replace it with a bottom-up working class democracy. The working class will not find any solution by the oppressor.

Aside from the mountain we all must climb, the anti-government morons packing guns I'm concerned are fueling themselves with a self-destructive and toxic anxiety, fear, hatred, and white nationalism (read racism) which may lead to a tragedy or tragedies. This could ignite a situation where these armed individuals are met with armed resistance, whereby giving the so-called authorities an excuse to implement martial law. Although, their rhetoric is anti-government, many mentally masturbate to the COPS show or their delusions of war. Ultimately, their actions will play right into big government plans. So the question for us to answer is, how orchestrated are they and by whom?
